Agreement to Terms

These Terms apply to your use of the UNIT 365 website and online store. If you do not agree, do not use the website or place an order. Additional terms from Shopify, payment providers, shipping carriers, Klaviyo, Meta, or other third-party services may also apply when you use those services.

Eligibility and Account Responsibility

You must be at least the age of majority in your state or have permission from a parent or legal guardian to use this website or place an order. You are responsible for the accuracy of information you provide, including contact, shipping, billing, and payment information.

Use of the Website

You may use the website only for lawful shopping and brand-related purposes. You may not interfere with site security, attempt unauthorized access, scrape or copy the website at scale, abuse forms or APIs, submit false information, misuse promotions, disrupt checkout, introduce malware, or use the site in a way that harms UNIT 365, customers, or service providers.

Products, Colors, Pricing, and Availability

• Product descriptions, photos, prices, colors, sizes, measurements, materials, inventory, and availability may change without notice.
• We make reasonable efforts to show products accurately, but screen settings, lighting, photography, and image editing may affect how colors and details appear.
• We may correct pricing, product, image, inventory, typographical, or technical errors at any time, including after an order is submitted.
• Limited drops, restocks, discounts, and promotional items may sell out or be limited by size, color, quantity, region, or time.

Orders and Acceptance

Submitting an order does not guarantee acceptance. Orders are subject to product availability, accurate information, payment authorization, fraud review, shipping restrictions, and acceptance by UNIT 365. We reserve the right to refuse, cancel, limit, or refund any order for reasons including suspected fraud, abuse, reseller activity, payment issues, pricing errors, inventory errors, address problems, or violation of these Terms.

Payment and Checkout

Checkout and payment processing are provided by Shopify and supported payment processors. By placing an order, you represent that you are authorized to use the selected payment method and that all billing information is accurate. We do not intentionally store full payment card numbers on our website. Third-party payment options such as Shop Pay, Apple Pay, PayPal, Visa, Klarna, or other providers may be subject to their own terms, approval requirements, fees, installment terms, privacy notices, and dispute processes.

Shipping, Delivery, and Risk of Loss

Shipping timelines are estimates and may vary due to processing time, carrier delays, address issues, holidays, weather, customs, fulfillment volume, or events outside our control. Risk of loss may pass to you when the order is delivered to the carrier or otherwise as provided by applicable law. You are responsible for providing a complete and accurate shipping address and for monitoring tracking information.

Returns, Exchanges, and Final Sale

Returns and exchanges must follow the current policy posted on our website or communicated at the time of purchase. Items may need to be unworn, unused, unwashed, undamaged, and returned with original packaging or tags to qualify. Certain items, discounted items, limited drops, worn items, damaged items, or final sale items may be ineligible for return or exchange where allowed by law.

Discounts, Gift Codes, and Promotions

Discounts, codes, and promotional offers may be limited by time, product, customer, order value, quantity, geography, or other conditions. We may modify, suspend, reject, or cancel promotions or orders using promotions if we detect misuse, fraud, technical errors, or activity inconsistent with the offer.

Email Marketing

If you subscribe to email marketing, you agree to receive promotional emails, launch updates, discount codes, product announcements, restock alerts, abandoned cart reminders, abandoned checkout reminders, browse abandonment messages, post-purchase messages, and related communications from UNIT 365. You can unsubscribe using the link in any marketing email. We may still send transactional or service emails related to orders, support, security, or account activity.

SMS Marketing Terms

If you provide your phone number and opt in to SMS marketing, you agree to receive recurring automated promotional text messages from UNIT 365 at the phone number provided, including cart reminders, checkout reminders, discount codes, restock alerts, launch updates, and product announcements. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe and HELP for help where supported. Carriers are not liable for delayed or undelivered messages. You represent that you are the account holder or authorized user of the phone number you provide.

Abandoned Cart, Checkout, and Browse Messages

When permitted, we may use Klaviyo, Shopify, cookies, pixels, and related technologies to remember products you viewed, added to cart, or started checkout with, and to send reminders by email or SMS if you subscribed or otherwise provided consent required by law. You can opt out of marketing messages as described above.

Privacy

Your use of the website is also governed by our Privacy Policy, which explains how we collect, use, share, and protect information, including Klaviyo email/SMS marketing, Meta Pixel advertising, cookies, checkout information, and privacy choices.

Intellectual Property

All content on this website, including UNIT 365 names, logos, marks, product designs, product photos, graphics, layout, text, videos, code, and brand elements, is owned by UNIT 365 or used with permission. You may not copy, reproduce, distribute, modify, sell, scrape, mirror, or reuse website content or brand assets without written permission.

User Submissions and Reviews

If you send us messages, feedback, photos, reviews, tags, social posts, or other content, you represent that you have the right to share it and that it does not violate anyone else's rights. You grant UNIT 365 permission to use, repost, display, edit, and publish that content for customer service, marketing, website, social media, and business purposes unless prohibited by law or agreed otherwise in writing.

Third-Party Services and Links

The website may include links to or integrations with third-party services, including Shopify, payment processors, shipping carriers, Klaviyo, Meta, social platforms, and analytics or advertising providers. We are not responsible for third-party websites, services, policies, errors, outages, approvals, or decisions.

Security and Prohibited Activity

We may use technical safeguards, rate limits, spam filters, fraud tools, and security monitoring to protect the website. You may not bypass security controls, test vulnerabilities without permission, submit malicious code, automate abusive traffic, interfere with checkout, misuse APIs, or attempt to access information not intended for you.

Disclaimer of Warranties

To the fullest extent permitted by law, the website, content, and products are provided "as is" and "as available." We do not guarantee that the website will be uninterrupted, error-free, secure, current, or free from harmful components, or that product information will always be complete or accurate.

Limitation of Liability

To the fullest extent permitted by law, UNIT 365 and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages arising from your use of the website, purchase of products, delivery delays, third-party services, marketing communications, or reliance on website content. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless UNIT 365 from claims, damages, losses, liabilities, costs, and expenses arising from your misuse of the website, violation of these Terms, violation of law, fraud, unauthorized payment use, or infringement of another person's rights.

Force Majeure

We are not responsible for delays or failures caused by events outside our reasonable control, including carrier delays, supply issues, labor disruptions, severe weather, natural disasters, power or internet outages, platform outages, payment processor issues, cyber incidents, war, governmental action, or emergencies.

Governing Law

These Terms are governed by the laws applicable to UNIT 365's business operations, without regard to conflict of law principles. Any claim must be brought in a court with proper jurisdiction unless another process is required by law. Some consumer protection laws may give you rights that cannot be waived.

Severability

If any part of these Terms is found invalid or unenforceable, the remaining parts will remain in effect to the fullest extent permitted by law.

Changes to These Terms

We may update these Terms periodically. Updated Terms are effective when posted unless a later date is stated. Your continued use of the website after updates means you accept the revised Terms.
